Export Terms & Conditions

1. Scope of Export Terms

These Export Terms and Conditions apply to all international trade transactions conducted by Dharti Exim LLP. These terms supplement our general Terms of Service and govern the export of spices, textiles, and agricultural products from India.

2. Incoterms

We operate under Incoterms 2020. Common terms we offer include:

• FOB (Free On Board): Seller delivers goods on board the vessel at the named port of shipment
• CIF (Cost, Insurance, and Freight): Seller pays for shipping and insurance to the destination port
• CFR (Cost and Freight): Seller pays for shipping to the destination port (insurance by buyer)
• EXW (Ex Works): Buyer collects goods from our warehouse in Ahmedabad
• FCA (Free Carrier): Seller delivers goods to a carrier nominated by the buyer

The specific Incoterm will be agreed upon in the sales contract.

3. Minimum Order Quantities (MOQ)

Minimum order quantities vary by product category:

• Spices: 500 kg per variety (or 1 full container load)
• Textiles: 1000 meters per fabric type
• Agricultural Products: 1 metric ton per variety

Mixed container loads are available subject to compatibility and minimum quantities per product.

4. Pricing and Currency

All prices are quoted in USD (United States Dollars) unless otherwise agreed. Prices are subject to change based on market conditions, currency fluctuations, and commodity prices. Confirmed orders are honored at the agreed price for 30 days from quotation date.

5. Documentation

We provide the following export documentation:

• Commercial Invoice
• Packing List
• Bill of Lading (B/L) or Airway Bill (AWB)
• Certificate of Origin
• Phytosanitary Certificate (for agricultural products)
• Quality/Analysis Certificate
• Fumigation Certificate (if required)
• Insurance Certificate (for CIF terms)
• GSP Certificate (if applicable)
• Any other documents required by the destination country

6. Quality Standards and Inspection

All products comply with:

• FSSAI (Food Safety and Standards Authority of India) standards
• APEDA (Agricultural and Processed Food Products Export Development Authority) guidelines
• International quality standards (ISO, HACCP, etc.)
• Buyer-specified quality parameters

Pre-shipment inspection by third-party agencies (SGS, Bureau Veritas, etc.) can be arranged at buyer's cost.

7. Packaging and Labeling

Products are packaged in export-worthy materials suitable for international shipping. Standard packaging includes moisture-proof bags, cartons, and palletization. Custom packaging and private labeling are available upon request at additional cost.

8. Delivery and Lead Time

Standard lead times:

• Order confirmation to shipment: 15-30 days
• Sea freight: 20-45 days depending on destination
• Air freight: 5-10 days

Lead times may vary based on product availability, order size, and destination. We are not liable for delays caused by customs, port congestion, or carrier issues.

9. Insurance

For CIF shipments, we arrange marine insurance covering 110% of invoice value. For other terms, buyers are responsible for arranging insurance. We recommend comprehensive coverage including all risks, war, and strikes clauses.

10. Force Majeure

We are not liable for delays or non-performance due to circumstances beyond our control, including but not limited to: natural disasters, war, strikes, government actions, pandemics, crop failures, or transportation disruptions.

11. Dispute Resolution

Any disputes arising from export transactions shall be resolved through arbitration in Ahmedabad, India, in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English.

12. Compliance

Buyers must comply with all import regulations, customs requirements, and food safety standards of their country. We provide necessary documentation but are not responsible for import clearance or compliance in the destination country.
